Coffs Harbour Motel Sales: Planning for Card Disputes After Settlement

A Coffs Harbour motel sale can involve card payments taken before settlement for stays occurring either side of the ownership change. A later payment dispute may therefore reach the seller after the purchaser has begun operating.
Preparing for that possibility helps both parties understand which records, payment facilities and contractual arrangements need attention.
Understand What a Chargeback Means
A chargeback involves a card transaction being disputed through the cardholder’s financial institution.
Westpac identifies several possible causes, including unauthorised payments, processing errors and services not received or not matching their description.
A chargeback is different from the motel voluntarily processing a refund. Establish which process applies before taking action, particularly where the cardholder has already lodged a dispute.
Identify the Merchant Behind Each Payment
Record which legal entity and merchant facility processed relevant transactions. Distinguish payments taken directly by the motel from payments handled by a booking platform or other intermediary.
As a practical preparation exercise, trace a direct booking from confirmation through to the merchant statement and bank receipt.
This can reveal whether the trading name seen by the guest differs from the name appearing on the card statement. Explain those differences to the buyer and relevant provider.
Agree the Responsibilities Across Settlement
Have advisers document how pre-settlement transactions, later refunds and disputes will be handled.
The agreement between buyer and seller should address cooperation, access to supporting information and any reimbursement arrangements. It should also identify the person authorised to communicate with the payment provider.
Do not assume the sale contract changes the bank’s rights under its merchant agreement. Confirm the provider’s requirements directly, including any obligations continuing after the facility stops processing new sales.
Keep the Evidence Accessible
Prepare a secure process for retrieving booking confirmations, applicable cancellation terms, guest communications and evidence that the stay occurred.
Westpac’s guidance explains that merchants may be asked to provide supporting documents and must respond within the timeframe in the dispute notice.
For a motel with several booking channels, identify where each type of record is held. The incoming operator should not have to search through unrelated personal emails to locate essential business information.
Arrange access consistently with privacy, security and recordkeeping obligations.
Should Staff Refund a Disputed Payment Immediately?
Check with the payment provider first.
Westpac warns that issuing a separate refund while a chargeback case is open can leave the merchant exposed to both processes. Follow the relevant provider’s instructions rather than applying another bank’s procedures automatically.
Prepare a brief handover note covering escalation contacts and how staff identify an existing dispute before responding to the guest.
